Here are some of the benefits realized by my clients (the sellers) on this HAFA Short Sale transaction:

1. The lender could not require a cash contribution or promissory note from the sellers.

2. The lender approved the list price even before listing the house.

3. The lender forfeited the ability to pursue a deficiency judgment against the seller.  This is the greatest benefit for homeowners who are doing short sale under this program, so after the sale, they don’t have to worry about any deficiency judgment after selling the house.

4. The lender paid the allowable closing costs for the seller to close the transaction.

5. The lender may pay the subordinate liens not more than 6% of the unpaid principle balance of their loan to release the lien and full release of borrower liability (No more fear of deficiency judgment from the second lien holder either!)

6. My clients received $3,000 as relocation expenses at close of escrow.

7.The lender paid the commissions; so no out of pocket expenses from the seller.

Short sale is a complex transaction involving coordination and cooperation amongst all parties involved in this transaction. Work with an experienced short sale real estate agent (LIKE ME!) that has experience in closing short sale.

Foothill Ranch FHA Approved CondosFoothill Ranch: There are four neighborhoods, or tracts, of homes designated as condominiums in Foothill Ranch.  Of the four neighborhoods of condos, three are attached condos/townhomes (Salerno, Vineyards, and Tuscany).  The remaining tract, Brittany, is a neighborhood of detached condominiums. As of September 27th, 2011 Salerno is the only condo project that is FHA approved in Foothill Ranch.

An Ounce Of Prevention: If you are planning on using an FHA loan to finance a condo it is vital to know ahead of time (before you waste time and effort touring homes that are not eligible) which tracts/neighborhoods of condos are FHA approved. There is no exception to this FHA rule... the project/tract/neighborhood must be FHA approved.

Dave's Tip: It is also prudent to check the expiration date of a project's FHA approval.  At present time fewer and fewer condo projects are eligible to retain FHA approval after the expiration date transpires.  You must have the FHA approval number on your loan prior to expiration date for the project.

Home Shopping Without A Pre-Approval Is A Waste Of Time

The Landscape Has Changed. If you haven't purchased and financed a home in the last four years you may be surprised at the changes in the mortgage approval process.  Save yourself the anquish of finding and losing a home that you want due to lack of preparedness.  Most listings will not even look at an offer unless a genuine pre-approval from a reputable source is provided with the offer.  Yes, it is a buyer's market... but sellers have learned to make sure that a buyer is truly qualified before taking their home off the market and entering escrow.  Jane's blog post gives you 7 compelling reasons to get your pre-approval before you begin looking at homes.

Here's 7 reasons to get a loan pre-approval before you go house shopping.

 

1.  The homes you look at may be over or under what you can afford, knowing what price you are approved for and also being comfortable with your payment before you go home shopping will make the process go more smoothly.

2.  If you love the house and want to write an offer you must have a pre-approval and it could be gone by the time you get your pre-approval in order.  Even waiting a day can mean missing out on the perfect home.

3.  Sellers and their agents will not take your offer seriously if you are not pre-approved.

Price Trends

Foothill Ranch Homes Median Sale Price

Understand the difference between "listing prices" (what sellers are asking for in Foothill Ranch) and "sold prices" (what buyers are willing to pay in Foothill Ranch).

By comparing these price trends, you'll have a good idea of where the market is heading. The median listing and sold property prices are calculated based on the market activity in Foothill Ranch each month and the graph above includes both detached SFRs and attached condos and townhomes.

Underwater Homeowners and Short Sale Sellers: Beware of Bank of America and Titanium Agents

Their audacity is amazing.  Now Bank of America wants you to use their agent for a short sale.  Is that agent with Titanium looking out for your best interests or Bank of America's best interests?  I think we all know the answer to that.  Liz Weintraub's post about this development is well-written and quite informative.

bank of americaBank of America is probably going to put a big black mark next to my name for this blog. But who really gives a rats? I close a lot of Bank of America short sales. I'm just a Sacramento short sale agent who is looking out for her clients.

Which is more than I can say about your bank. Banks have one customer, and it's not you. It's their shareholders. If you have a loan with Bank of America, and your home is underwater, Bank of America wants to do something about it.

If you haven't already heard from Bank of America in August, you probably will. Bank of America is working in affiliation with Titanium real estate agents. I caution homeowners against hiring a real estate agent who is affiliated with their bank. I also wonder how a real estate agent can maintain a fiduciary relationship with a home seller when their parent company is tangled up with Bank of America.

This is the August maneuver presently underway by Bank of America and Titanium agents. Bank of America is sending out FedX packages to homeowners who own underwater homes and might be a good candidate for a short sale. A Titanium agent is required to follow up with the homeowner, shoot photographs of the property and send back a report, the photos and the homeowner's FedX package to Bank of America. Don't believe me? Sound too Big Brotherish to you? I have a confidential copy* of the memo that went out to all Titanium agents.

If you are a Bank of America short sale candidate, stop and think. Ask yourself these 3 questions:

  1. Do you want to hire a contractor for Bank of America to represent YOU as YOUR real estate agent?
  2. Do you feel a loyalty to Bank of America?
  3. Do you think Bank of America and its third-party agents at Titanium have your best interests at heart?

If your answer is yes, then by all means, work with that Titanium agent. I'm here to tell you that Bank of America is banking on your naivety and ignorance. So far, it's been doing a pretty good job.

If your answer is no way, Jose, then find yourself the best short sale agent in your area and hire that person as independent party to work with you. Whether you realize it, you still own your home, you still call the shots. Don't hire some agent who works for your bank. Hire an agent who will work solely for you. Because the agent's commission is paid from the sale proceeds and approved by the bank -- that commission is not coming out of your pocket. Since you're not personally doling out the commission, you may as well hire the best. The best is probably not your bank. Beware.
